    I was a day late sending complaint email. I sed anyway.
    I also send a complaint to local TV , asking for help.

    Better late than never, just a thanks, keep the faith, the longer we push the better chance we have, and keep writing and posting all you can. The TV idea was a good one , let us know if you hear back from them. Terry

    Did anyone receive an email today from Claton Voegtle re: signing a contract for the class action suit against RCI? He basically was stating that it was unfair to place the burden on the primary plaintiff to pay the legal fees if the suit would fail. He stated there would not be a suit unless more people signed the contract and shared the responsibility. Below was my response to Mr. Voegtle. It pretty much sums up my feelings about getting involved in the suit at this time. I would suggest if anyone else gets a letter from him, they respond similarly.

    You are indeed correct… it is not fair for only one person to take all of the risk associated with the suit. However, things have changed dramatically since you started working on this class action. When this suit was originally requested, it was strictly the Blue Bay/ Temptation owners that were being discriminated against and their ability to use points for Points Partners was limited by RCI to 60,000.

    Beginning on December 10, 2008, RCI revised their Points Partner Program yet again. Now they state “As a Member you may use 33% of your annual Points allotment, up to a maximum of 250,000 Points. All Members can use a minimum of 25,000 Points, regardless of your annual allocation!”

    In the attached Terms & Conditions document that is posted on the RCI website, it also states (in paragraph #5) that “RCI Members who purchased interests at a Blue Bay Resort (including Blue Bay Club and the Blue Bay Getaway, later known as Temptation Resort Spa) prior to February 29, 2008 may use up to a maximum of 60,000 (sixty thousand) Points per calendar year on RCI Points Partner transactions.”

    Based on these changes, the restrictions on the use of points affect more than just our group of people and it further demonstrates RCI’s ability to “change the rules as they wish”. Prior to these changes our limitations were more obviously blatant. Now they have restricted their entire membership with regards to the Points Partners Program!

    Basically, my concern is now the legal strength of our claim against RCI since all their members are now limited in one way or another. Neither you or Mr. Katz , as our potential representation, have mentioned anything to me or (to the best of my knowledge) the rest of our group, any insight or thoughts on how these recent changes will affect the strength and validity of our claim. Forgive me for being a little “gun shy” but I’ve already been burned by Premier & RCI and I’m very reluctant to commit to pay another couple thousand dollars if this suit is deemed unfounded or frivolous.

    As I have mentioned in the past, there is now a website/forum ( www.desirenakedtruth.com )which was created by current & former Premier sales staff trying to organize a group together of people like myself which have been scammed by Premier and/or RCI. They have in excess of 160 members registered on the site. I would strongly suggest you visit the site and take a look at the information provided and to see if you think you can attract more people to take part in this suit which could substantially reduce the monetary risk for each member. Perhaps you could register and post a plea on there, stating how strong a claim we may or may not have against RCI and how to be included in the class action. I know how long this has dragged on, but I and a lot of my fellow “members” probably need some reassurance that this whole situation has been aggressively researched and that we have a case that is strong enough to win and/or generate a substantial settlement before even going to trial. Thank you for your time and I hope this will result in some valuable insight into why more people have not submitted their contracts to you.

    Good write up Slotman.

    Seems to me many RCI members are in the same boat as Premier Members.

    Anyone look at TUG yet and see if any chatter on there?

    Well stated, Slotman. Also, if you get ENDLESS VACATION, which is RCI's magazine, check out page 94. It shows the result of a settlement of a class action suit vs. RCI for their weeks program. There is a link on RCI.com and if you look, the members don't get very much in the way of settlement, yet the attorneys seem to be seeking $4,000,000 in legal fees.

    The people at TUG new about the changes that effected them before the Dec 10 dead line to use their points with points partners. There has been little chatter there about it sense then( I have not check there in the last few weeks but I would not expect much) Terry
