    Does anyone actually have a copy of this liability release that has been mentioned. I would love to get a copy to hand over to a lawyer with all the other documentation I have been collecting.

    Several months ago I sent a letter via email to the law firm of Mata, Casillas, and Urrutia to inquire about a potential class action lawsuit against Premier. I sent copies of this letter to several members I have met at Temptations and it subsequently showed up on this thread. If you have been following this thread, then you read that letter.

    Unfortunately, I never got a response to that letter. This, in my opinion, tells me they either represent Premier or are in their pocket somehow. I have never met a lawyer who would pass up the opportunity to make a buck if he felt there was a snowball's chance of winning the case.

    My wife and I recently returned from a stay at Temptations. Before posting on this thread I wanted to give Premier a final shot to plead their case face to face. When speaking to them on the phone it sounded like they were willing to exchange our points for all inclusive. This seemed to be an amicable solution to compensate our loss on the points partner program through RCI.

    As some of you have also experienced firsthand, this is not the case. They have no intention of giving us anything. Even all inclusive at their cost would have been a step in the right direction. They actually wanted my wife and me to spend an additional $4200. Don't ask me for what. By that time steam was coming out of my ears. Hello. I gave you $22,000 in cash and a redweek timeshare we paid $12,000 for and now you want more money? Where is the value we received for the $34,000 we already gave you? We all know that we can purchase packages from travel agencies for marginally more than what we are paying to stay at the resort.

    This prompted their "canned response" that the problem of restricting our points partner usage is entirely the fault of RCI. None of us paid money to RCI for our memberships. We paid Premier Resorts. If 4000 members paid an average of $10,000 each, Premier raked in 40 million dollars. Where did this money go? Hmmmm. There have been quite a few improvements at the resort this last year. Do you think??

    How much of this money went to RCI? My guess is little or nothing. According to what I have been told, the resort has been compensating RCI by providing rooms which they use for exchanges, extra vacations, and last minute vacations. The resort then benefits from the all inclusive charges. Pretty slick if you are Premier. How many rooms can RCI rent out?

    RCI, like any other travel agency, has to pay for the plane tickets, rental cars, hotels, etc. that we were all getting using points partners. I am not an advocate of RCI but if they were not being compensated fairly by Premier, can you blame them for cutting us off? They only make so much off the rooms. My guess is they had no idea Premier was doling out millions of these points like M and M's until they were flooded with requests for plane tickets, etc.

    Virtually all of us were sucked in on the promotion of using all these points without any restrictions when we purchased our memberships. I personally believe that this was entirely premeditated and that we are the victims of consumer fraud. I further believe Premier should pay for this.

    I am certainly willing to pay in proportion to my investment for any legal services to pursue a class action and benefit accordingly. Unfortunately, I do not have the time to to get totally involved. We need a good lawyer among us who knows how to best go about pursuing this farther without it requiring an unfair amount of his or her time. I tried once, but this is a little out of my realm.

    Hola, what did they offer you? How many AI weeks? What did you have left in points and how many points did you use? How long have you been a member? Sorry to ask all the questions but I need to know so I will know what to expect. We have our value is near yours. I am guessing the 4200 is the sells guys wanting to make a comission, they are not paid work only on comission. From what I understand you are right RCI only makes money on fees. Terry

    I totally agree w/ Sleepiedog as to who is at blame. I am certain that Premier not only scammed all of us but also RCI. The only thing I find amazing is the fact that RCI still does business with Premier by providing exchanges and reservations at their resort.
    Anyhow, as a result of posting a complaint on the consumer advocate website Squeakywheel.com a couple months ago, I was contacted by an attorney that is very interested in putting together a class action suit against both Premier & RCI. I have provided him with as much info as possible via email & fax. His name is Clayton Voegtle and his email address is Clayton@voegtlelaw.com. Today after not hearing from him in a few weeks he sent me the following update: "I am seeking a co counsel for a class action suit. and I hope to have one filed by next week."
    I would strongly suggest anyone interested in becoming a plaintiff to contact him via email. He has told me that class action suits are usually taken on a contigency basis and he would not get paid unless there is a settlement.

    I have spoken personally to Clayton, he told me that the person filing the suit will have to pay the filing fee......I am waiting to hear from him, I talked to him last Friday afternoon.
    He is VERY interested in anyone that would want to join in....he is in Illinois and happens to be about 20 minutes from where I live. I will call him tomorrow and see if I can set up an appointment to go see him as soon as he can.

    I can keep everyone posted if they would like. I dont think it would be very soon that you would see any movement on RCI or Premier side in the near future, I am sure they have some big time lawyers on their side!! Hopefully he will be able to at least make us whole (make them honor the contract the way it was written) or get our money back??

    sleepiedog I got the same thing as you while I was down there earlier in September, they wanted me to give them another 4000 and keep 3 weeks, and sell 2 to someone else that isnt in the program?? I have been thinking about this, and if this is what they now want you to do, why can Steve and John sell their Premier weeks again?? its exactly what they want us to do? get people in there that are not vacation owners so that they can pitch the lines to them.......seems to me to be the same thing they were doing before and the resort stopped them...

    Other than swallowing the loss I dont see any other way to get them to take us seriously other than getting an attorney.

    I have only conversed with Clayton via email. I live on the MS Gulf Coast and unfortunately will not have the opportunity to sit with him face to face. I would appreciate if you keep me in the loop about how your meeting goes and what kind of vibes you get from Mr. Voegtle. I hope that the filing fee isn't too steep, I'm already into Premier to the tune of $30K and I'm hesitant about spending any more money, but I agree that this is our only opportunity to get some sort of resolution to this issue.     Hola, I still dont blame the resort for this mess, RCI decided to change this because of reason 1 airlines pulling flights and reason 2 40 t0 50 people booking one flight at one time, why didnt they limit flights to 6 a year/. Just need to know the details of what you guys have, so I will know if what they offered you was fare or not. Just want to know the truth. Terry
