    I am digging deeper into what come next after PROFECO. I am trying to locate any other agency that will assist members who were ripped off. Right now the only course of action I am finding after PROFECO is through the court systems. If I find anything I will keep people posted.

    AI fees

    Just back had a great time as usual but unfortunatly came back to a family funeral so I will make this short.
    After some persistance I did meet with Claire. I was first given to Dennis delepnna who told me He was in charge (I assume in the spot Claire used to have ) and he could handle any issue Claire would have and she was to busy. I told him I really wanted to meet with Claire or Sandra as they are aware of any issues I have. He asked to take a shot as they were not available to meet with me even though I thought I had an appoitment with them. The customer service people who check you in tell you not to go to the sales room without making an appt through them (yea see how that worked!)! Dennis pretty much blew me off on the AI increase issue saying thats the hotel industry and theres not much we can do about it. He tried to tell me the increase was the mexican cpi plus taxes and that was the 15-18%. Shortly after leaving a note was delivered to me explaining that neither Sandra or Claire were aware they had a meeting scheduled with me. I saw them the next day. Most of my issues did get resolved and I did sit down with claire over the AI fee increase. I told her this was not just my issue that the members who have seen the new fees are livid and that will grow as more become aware. I showed her my documentation and the AI fees available on the internet. She said they too were surprised (2 weeks ago) by the huge increase and agree that it is exhorbitant. She is meeting with the hotel to discuss the violation of the amout of the increase . I told her I would be in touch to see how it turns out. She did mention that the rates were rolled back once before in response to members complaints so I take that to mean each and everyone of you should make it a point to complain about the increase! The difference between the week I went this year and next year is $27 each per day! We looked it up right there in the office.

    Sorry to hear about your recent loss.

    Seems like the owners are getting greedy again...surprise surprise @ that. If they don't do a roll back as they have in the past when they tried to "stick it to us" they will price themselves out of the market.

    Glad to hear that Claire listened to you and will bring the matter up to the owners (hate to say this though...as long as she is not blowing sunshine up our asses just to appease us). I have no reason to doubt Claire personally and mean no disrespect to her but previous people in her position...let us say the past speaks for itself and therefore I am a bit wary at this point. I will keep an open mind though and sincerely hope that Claire can and will convince the owners to right this situation.

    Sorry about your lost.

    Reality is they should roll them back to about 2004ish prices to be in line with similar resorts.

    Are they doing anything about the AI fees for 2010? I got a quote on our trip in May and its 2x as much as I can get the room on skoosh.com. I know we get a few perks but they are no were near worth paying 2x as much for the exact same thing for...thoughts?

    the rate increase is in direct violation of my contract. This exceeds the National Pricing index. This is one of the complaints I made with PROFECO. I have demanded that all 14 complaints be addressed individually. Premier will have to write a resopnse to each issue and a solution. I have a spread sheet specifically for the pricing change and how it is drastically different from what they are under contract to do.

    BUT, we all know what Premier thinks of the contract. They violate it all the time and are not held accountable.

    Again I say don't just complain here. Make sure you are each notifying Premier of you issue with the AI fee increase.

    Good point and consider it done from our end. DO wish I could find what the actual National Pricing Index is for 09/10. Would add some meat to the complaint and could be used with PROFECO.

    If PROFECO called the Owner's lawyers in for every complaint, it would be pretty damn expensive for them in the long run. At least we would be hitting them in the pocket book as they are doing to us.

    This is the email I am sending to Claire Wright.

    Claire,

    We recently looked at the new AI rates in 2010 for Temptations and Desire. Based on our contract which we purchased in 2006 the new AI rates EXCEED the Mexico Consumer index pricing as stated in our contract. According to the Eight clause of our contract (Flucuation of Pre-paid all-inclusive and all-inclusive fees) The 2010 rates exceed what our contract states.

    The Inflation rate per year is as follows:
    Inflation rate for 2007 (est. 2006) = 3.4%
    Inflation rate for 2008 (est. 2007) = 4.0%
    Inflation rate for 2009 (est. 2008) = 5.10%
    Inflation rate for 2010 (estimated in 2009) 4.89%

    The rates stated in our contract for 2006 at Desire Resort and Spa were as follows PER COUPLE per night:
    Desire Resort and Spa
    Jan 4- April 30 = $260 Per couple
    May 1 – Dec. 22 = $240 Per couple
    Dec 23 – Jan 3 = $260 Per couple

    Based on these National Index Change rates I have calculated what the members rates should be per our written contract eight clause between 2007 thru 2010. These rates are as follows:
    • Desire 2007 Pricing should have been per our Contract:
    Jan 4- April 30 = $260 Per couple + 3.4% = $268.84 per couple
    May 1 – Dec. 22 = $240 Per couple + 3.4% =$248.16 per couple
    Dec 23 – Jan 3 = $260 Per couple + 3.4% = $268.84 per couple
    • Desire 2008: Pricing should have been per our Contract:
    Jan 4- April 30 = $268.84 Per couple + 4.0% = $279.59 per couple
    May 1 – Dec. 22 = $248.16 Per couple + 4.0% = $258.09 Per couple
    Dec 23 – Jan 3 = $268.84 Per couple + 4.0% = $279.59 per couple

    • Desire 2009 Pricing should have been per our Contract::
    Jan 4- April 30 = $279.59 Per couple + 5.10% = $293.85 Per couple
    May 1 – Dec. 22 = $258.09 Per couple + 5.10% = $271.25 Per couple
    Dec 23 – Jan 3 = $279.59 Per couple + 5.10% = $293.85 Per couple

    • Desire 2010 - What our MEMBERS Rates Per our contract should be this year:
    Jan 4- April 30 = $293.85 Per couple + 4.89% = $308.22 per couple
    May 1 – Dec. 22 = $271.25 Per couple + 4.89% = 284.51 per couple
    Dec 23 – Jan 3 = $293.85 Per couple + 4.89% = $308.22 per couple

    • Desire Current 2010 Members rates as advertised online PER COUPLE:
    Jan3- Jan 31 = $510 Difference from Contract rate =$201.78or 65.47% per day per couple
    Feb 1-Feb 26 = $460 Difference from Contract rate=$151.78 or 46.24% per day per couple
    Feb 27-March31= 510 Difference from Contract rate = $201.78 or 65.47% per day per day
    April 1 – April 31 = $460 Difference from Contract rate=$151.78 or 46.24% per day per couple May 1 – Dec 25 = $344 Difference from Contract rate = $59.49 or 20.91% per day per couple
    Dec 26 - Jan. 2 = Not posted


    Our Rates to Desire resort and Spa for 2010 should be as follows per our contract when considering the eight clause:
    Jan 4- April 30 = $308.22 per couple
    May 1 – Dec. 22 = $ 284.51 per couple
    Dec 23 – Jan 3 = $308.22 per couple

    Can you verify the rates I calculated are correct? If not I would appreciate a written explanation as to why the current rates online are correct when our contract clearly states the rates increase or decrease in direct proportion that of the National index of prices and I have supplied what the rate changes should have been since our contract inception and what the current rates should be based on these National index rate changes.









    The rates stated in our contract for 2006 For Temptations (Formerly known as Blue Bay Getaway) were as follows:
    • Temptations
    Jan3- Jan 31 = $71 pp
    Feb 1-Apr 3 = $77 PP
    Apr 4-June 30 = $71 PP
    July 1 - Aug 14 = $71 PP
    Aug 15 - Dec 22 = $68 PP
    Dec 23 - Jan. 2 = $107 PP

    Based on these National Index Change rates I have calculated what the members rates should be per our written contract between 2007 thru 2010. These rates are as follows:
    • Temptations 2007:
    Jan3- Jan 31 = $71 pp + 3.4% = $73.41
    Feb 1-Apr 3 = $77 PP + 3.4% =$79.62
    Apr 4-June 30 = $71 PP + 3.4% = $73.41
    July 1 - Aug 14 = $71 PP + 3.4% = $73.41
    Aug 15 - Dec 22 = $68 PP + 3.4% = $70.31
    Dec 23 - Jan. 2 = $107 PP + 3.4% = $110.64
    • Temptations 2008:
    Jan3- Jan 31 = $73.41 + 4.0% = $76.35
    Feb 1-Apr 3 = 79.62 + 4.0% = $82.80
    Apr 4-June 30 = $73.41 + 4.0% = $76.35
    July 1 - Aug 14 = $73.41 + 4.0% = $76.35
    Aug 15 - Dec 22 = $70.31 + 4.0% = $73.12
    Dec 23 - Jan. 2 = $110.64 + 4.0% = $115.06
    • Temptations 2009:

    • Temptations Current 2010 Members rates as advertised online:
    Jan3- Jan 31 = $95.20 Difference from Contract rate = $11.03 or 13.11% pp/per day
    Feb 1-Apr 3 = $112.32 Difference from Contract rate = $21.04 or 23.05% pp/per day
    Apr 4-June 30 = $96 Difference from Contract rate = $11.83 or 14.06 % pp/per day
    July 1 - Aug 14 = $103.20 Difference from Contract rate = $19.03 or 22.61% pp/per day

    Aug 15 - Dec 22 = $80.61 Per person per day double occupancy
    Dec 23 - Jan. 2 = $126.85 Per person per day double occupancy
