Hey there! Im new to the forum but not to TTR. Been there 7 or 8 times but never had the pleasure of meeting Chinos. He sounds like a great guy and I think what you are doing is tremendous.

But as an accountant let me just say one thing. I hope someone has checked into the taxation laws in Mexico in regard to the money you are giving him. If you have set up a foundation that the money goes into, no problem. But if you are giving Chinos direct access to the money without funneling it through a not for profit foundation, you may be setting him up to have to claim part or all of that money as income. That would either cost him money out of his pocket or take a huge bite out of the money raised.

My fear is that it might take the Mexicos Hacienda (their version of the IRS) a while to catch up to him and by that time whatever money hadnt been used wouldnt be enough to cover the accessed taxes and frankly he would be screwed.

Just some thoughts I felt complelled to put out there.
Do with it as you wish.

 

Yes we have spoken to Chinos and he is setting up a "Not For Profit" business bank account down there, and I have also said to him to make sure he keeps every receipt for the purchases he makes to show a paper trail.

I hope I dont offend anyone or appear to be nitpicking but that isnt going to be enough to insulate him from liability.

I spoke wtih the tax attorney in our Cancun office here who is an expert in Mexican Taxation Law.

He indicated that setting up a not for profit bank account isnt enough. You must actually establish a Not For Profit corpotration and name officers to that corporation. The officers could certainly be members here but I strongly suggest that Chinos NOT be an officer.

As an officer he would be legally precluded from using any of the funds for his own personal medical expenses or other such needs and could face criminal prosecution for misappropriation of funds if he did.

Like I said, I hope I havent offended anyone with my unsolicited advice but I have seen first hand how things can go when the necessary paperwork is not completed.

I strongly suggest that someone see a tax attorney or accountant and begin the process of establishing a not for profit corporation before any more money is spent. It will only benefit Chinos in the long run.

I wish I could offer my services or that of my firm pro bono but the after running it past the pro bono commitee here they are uncomfortable with setting up a not for profit that was basically established to meet the medical needs of one person.

But please, take what I have said into account as I know the last thing anyone on here wants to do is put Chinos in a bad position.
