"suspicion of speeding"? either he was or he wasn't...one does not stop a car to determine whether or not it was speeding. i'll betcha there was a real reason. in addition...yikes! :shock:
Remember... you are innocent until proven guilty. Ha! Actually you are given a court date on your citation in which to contest your ticket. Therefore it is still a "Pre-charge" until you go before the court and the outcome is determined. Hence the "suspicion". Unfortunately for this guy it also added up to probable cause. Not sure how that transpired unless he had the weed in "open view" or his car reeked of it (which probably did since he had more than 10 pounds in the car). Anyway, I would bet that a drug task force was keeping tabs on him and used the traffic violation to snowball it into what it did. Wouldn't it be something if dude got out of the speeding ticket thus eliminating Probable Cause? Essentially this case is built on him speeding because if he wasn't speeding there would have been no reason to stop him (according to the article).
Your right Michael, the article is VERY poorly written and proly the worst one that I've seen on the internet regarding this incident. The guy was stopped for speeding. They had been ivestigating him for months before he was stopped and they knew who he was prior to stopping him. Once they found the weed in the car, that probably gave the judge enough reason to find probable cause to sign a search warrant for all properties which he had connections to. None of the ariticles that I've seen indicate where in the car the weed was found though......if in plain view, he's screwed. If it was found out of sight, he could have a viable motion to quash the arrest, just depending on which version of the facts the judge buys into. Michelle
